Security Decree and CBD: What's really going on?

Update May 2025 – The new Security Decree , approved by the Government and signed on 11 April 2025, is creating enormous confusion and concern in the industrial hemp sector and among all those who use CBD for therapeutic purposes .

Let's see together, in a clear and updated way, what the infamous Article 18 of the decree provides, why it is considered unconstitutional , and why therapeutic CBD remains legal and not subject to restrictions.

The regions demand clarity: "Protect the hemp supply chain!"

All Italian regions have unanimously called on the Ministry of Health to revise Article 18. The request is clear: not to damage a legal production sector , with thousands of certified companies, public investments, and tens of thousands of jobs.

What does the new Article 18 provide?

The Security Decree modifies Law 242/2016 , imposing:

  • The total ban on the production, processing, sale and distribution of hemp inflorescences, even with THC < 0.2%

  • No distinction between CBD, CBG or THC

  • The criminalization of derivatives such as oils, extracts, resins

  • The inclusion of these activities among the crimes provided for by the Consolidated Law on Narcotics

This law severely affects the entire hemp industry , not just cannabis shops.

Serious inconsistencies in Article 18

  • Lack of distinction between cannabinoids

    • No difference between inflorescences with THC (psychoactive) and CBD (non-psychoactive).

    • Paradoxical, because CBD is recognized by science as non-drug and therapeutic.

  • The seed “trick”

    • The use of the flower would be permitted only if "proven" to produce seeds. A vague clause, almost unenforceable in practice.

  • No protection for existing stocks

    • Companies find themselves overnight with products that have become illegal , with no instructions on what to do or the possibility of a refund.

An unconstitutional decree

The Constitutional Court will rule on May 26, 2025. Numerous jurists and associations (including Canapa Sativa Italia and Imprenditori Canapa Italia) have already filed an appeal.

Reasons for unconstitutionality:

  • Violation of the hierarchy of sources : Italian law cannot prevail over European law.

  • Failure to notify the European Commission : an obligation for all “technical regulations” affecting the internal market.

  • Contradicts EU Court of Justice rulings : Low-THC cannabis is legal and cannot be banned without scientific evidence of the risks.

🌍 Europe defends the hemp sector

  • The European Court of Justice , with its ruling C-793/22 , has established that:

    “Member States may not prohibit the cultivation or sale of industrial hemp inflorescences.”

  • The European Commission has opened an investigation into Article 18.

  • The European Parliament could intervene in case of violation of the Treaty on the Functioning of the EU .
